II. PUBLIC HEARING
A) Adding "Before and After School Programs" as an accessory use for churches, chapels, or synagogues as a Conditional Permitted Use in the R-1 Residential District
B) In the Matter of Granting a Conditional Use Permit for an "After School Program" to St. Martin’s Church located at 8401 North 60th Street in the R-2 Residential Zoning District
Items A and B were considered simultaneously. Mr. Van Gompel noted corrections to the agenda. Mr. McGuigan asked if the public hearing will have to be rescheduled due to the corrections to the agenda. Attorney Dineen said that the public hearing notices were satisfactory.
Mr. Van Gompel identified the purpose of the public hearing. He discussed the proposal and the conditional permitted use requirements.
Ramona Lewis, requestor of the conditional use permit, discussed her experiences with the alcohol and drug prevention programs at the Brown Deer High School. She noted that a grant was received to provide drug and alcohol prevention services to the middle school students. The proposed after school program will be implemented by the YMCA, Brown Deer Middle School, and a local counseling services firm. She discussed the program times, registration procedures, planned activities, and provided transportation.
Toni Markiewicz (8237 North 44th Street) noted concerns regarding the incompleteness of the plan as presented, and suggested that the item be laid over until specific details can be provided and the Community Development Director position is filled.
Harold Bourne (6415 West Carolann Drive) noted that it is costly and difficult to develop a plan without understanding if a conditional use permit would be granted. He spoke in favor of the program, noting that this program would serve the youth of the community in a positive manner.
Ann Lutz (6260 West Dean Road) expressed concern about the lack of cooperation from the St. Martin’s Church in earlier circumstances, and expressed a lack of trust with the Church.
Reverend Ken Guy, of St. Martin’s Church, noted that the issue presented by Ms. Lutz has no relevance to the proposed after school program, and that the earlier issues were resolved.
Pat Renner (8503 North 60th Street) expressed opposition to allowing the proposed use at a church.
Lynn Drumm (8409 North 59th Street) expressed concern about supervision of the children at the program.
Kathy Horn, patron of St. Martin’s Church, noted that St. Martin’s Church would be a good location to provide a safe environment for children after school hours.
Karen Gosse (6559 West Pierner Place) discussed concerns about setting a precedence for this conditional use in residential districts. She asked if the after school program at Dean School allows middle school children. She questioned the scheduling of the program and activities.
Discussion continued regarding the different facilities, scope of the program, and options for locating the program at a church.
Gary Slotke (8503 North 60th Street) expressed concern about the program location at St. Martin’s Church, the necessary supervision of the children, and the lack of responsiveness from the church in earlier matters.
Larry Lewis, requestor of the conditional use permit, discussed past events at St. Martin’s Church. He noted that the Church is only asking permission to be a location for the program to take place, and any program must also be approved by the school, which will require proper supervision and management of the children.
Ms. Horn noted that the church will be a safe place for children to go after school.
Ms. Renner expressed concern about traffic in the area, the safety of the children, and the treatment of her property by children in the program.
Attorney Dineen discussed the permitted uses and the inclusion of churches in the R-1 district. He questioned other requirements and necessary approvals for the operation of an after school program.
Mr. Van Gompel noted that if the program is held in the school or the YMCA a conditional use permit would not be required.
Ms. Markiewicz discussed safety concerns as children travel between the school and church, and noted that other conditional use permits are currently being scrutinized and reviewed for their appropriateness.
Trustee Schilz asked if Bruce Connolly, school district superintendent, should be involved in the approval of this program. He noted that the information provided is too vague and prior approval should be provided by the School District.
Barb Fleming noted that Richard Zimman, high school principal, is the director of drug and alcohol reduction program at the school district. The medallion program, an after school program at Dean School, is operated by a private agency. She discussed the scope of the programs provided by the school district with regards to this matter.
Ms. Drumm asked if the DARE program is continuing and may be duplicating the services proposed by this program. She noted concerns about adequate supervision.
Mr. Lewis noted that St. Martin’s Church is not coordinating the program, but only providing for a location for the program to take place.
Ms. Bellehumeur asked about the cost of the program, the tutoring services offered, the scheduling of the program, and the number of children who will be participating.
Trustee Krueger said that the number of children to be involved should be specified. He said that additional options may be possible with further coordination between the church, YMCA, and school district.
Mr. Raffensperger asked if the purpose will be more of a day care situation. Mr. Van Gompel noted that the definition of the after school program is different from the educational function and day care function as identified in the zoning code.
Dwayne Kiel (8984 Wabash Avenue) asked about the proposed conditional use and the use of the church as a school facility.
Mr. Bourne said that the Village does not appear to be in a position to grant the conditional use permit at this time, and that the Village should consider creative programs for children during after school hours.
Ms. Drumm asked about the length of time that the conditional permitted use would be in place. Attorney Dineen noted that the proposed use, if approved, would be a conditional permitted use in the R-1 zoning district from that time forward.

IV. PERSONS DESIRING TO BE HEARD
Mr. McGuigan requested that the Village consider means to prohibit unattractive businesses in the community, including gun shops, check cashing shops, pornography shops, and storefront churches. He noted that these locations are considered uses that bring down the value in a community and cause fear and lack of confidence in the local community. He asked for a copy of the zoning codes, listing of available parcels in the Village, and notification of anticipated redevelopment projects that will be coming forward in the future.
V. CONSIDERATION OF MINUTES: August 7, 2000 - Special Meeting
August 14, 2000 - Regular Meeting
It was moved by Ms. Bellehumeur and seconded by Trustee Krueger to approve the August 7, 2000 special meeting minutes as presented. The motion carried unanimously, with Mr. Raffensperger abstaining.
It was moved by Mr. Raffensperger and seconded by Ms. Bellehumeur to approve the August 14, 2000 regular meeting minutes as presented. The motion carried unanimously.
VI. REPORT OF STAFF
Mr. Van Gompel reported that the hiring process for the Community Development Director is continuing this month. He noted that Village staff will propose changes to conditional permitted uses in the R-4 Residential zoning district at a future meeting.

VIII. NEW BUSINESS
A) Ordinance entitled, "Adding "Before and After School Programs" as an accessory use for churches, chapels, or synagogues as a Conditional Permitted Use in the R-4 Residential District"
It was moved by Mr. Raffensperger and seconded by Mr. McGuigan to recommend that the Village Board not approve Ordinance No. 00-, "Adding "Before and After School Programs" as an accessory use for churches, chapels, or synagogues as a Conditional Permitted Use in the R-4 Residential District". Mr. McGuigan noted that the plan is incomplete as presented, however agreed that the program may be beneficial in the community. He asked for an endorsement of the plan by the School Board. Mr. Raffensperger expressed concern that the function would be similar to a day care facility. Ms. Bellehumeur asked that the YMCA and School Board be a part of the official plan that is presented. The motion carried unanimously.
B) Resolution entitled, "In the Matter of Granting a Conditional Use Permit for an "After School Program" to St. Martin’s Church located at 8401 North 60th Street in the R-4 Residential Zoning District"
It was moved by Mr. McGuigan and seconded by Mr. Carl Krueger to recommend that the Village Board not approve Resolution No. 00-, "In the Matter of Granting a Conditional Use Permit for an "After School Program" to St. Martin’s Church located at 8401 North 60th Street in the R-4 Residential Zoning District." President Wolfgram asked for further information from the presenters should the project be proposed again. The motion carried unanimously.
C) Reschedule Public Hearing in the Matter Regarding the Approval of an International House of Pancakes (IHOP) Restaurant Located at 5300 West Brown Deer Road in the M Manufacturing Zoning District to October 9, 2000
It was moved by Mr. McGuigan and seconded by Mr. Raffensperger to recommend that the Village Board reschedule the Public Hearing in the Matter Regarding the Approval of an International House of Pancakes (IHOP) Restaurant Located at 5300 West Brown Deer Road in the M Manufacturing Zoning District to October 9, 2000. The motion carried unanimously.
IX. ADJOURNMENT
It was moved by Mr. Raffensperger and seconded by Ms. Bellehumeur to adjourn. The motion carried unanimously at 8:56 P.M.
