JULY 9, 2001 MEETING MINUTES

HELD AT THE BROWN DEER VILLAGE HALL

4800 WEST GREEN BROOK DRIVE

The meeting was called to order by Village President Margaret Jaberg at 7:32 P.M.

I. ROLL CALL

Present: Village President Margaret Jaberg, Trustee Yvonne Nealy, Trustee Tim Schilz; Commissioners Susan Bellehumeur, Carl Krueger, Jim McGuigan, John Raffensperger, and Debra Falk

Also Present: Trustee Jeff Baker; Susan Schneider, and Mary Kay Buratto, Community Development Director.

Excused: Commissioner Jerry Schmitz and Russell Van Gompel, Village Manager

II. PERSONS DESIRING TO BE HEARD

Mr. Eugene Malloy, 8949 North Silver Brook Lane, asked to be provided with a copy of the recent ordinance changing the composition of the Plan Commission. He asked if the absence of the Village Engineer had been addressed and if the Commissioners could have nameplates at their places identifying them.

III. CONSIDERATION OF MINUTES: June 11, 2001 Regular Meeting

It was moved by Commissioner Krueger and seconded by Commissioner Bellehumeur to approve the minutes as presented. Motion carried unanimously.

IV. REPORT OF STAFF/COMMISSION MEMBERS

Mary Kay told Commissioners that the Fleming Companies, owners of the Sentry/Fresh For Less food store, have petitioned the Village for a Conditional Use Permit for a four-pump fuel center at the Sentry site. Despite the unanimous denial of concept approval by the Plan Commission, the company wishes to prepare fully engineered site plans and come back to the Plan Commission seeking a recommendation to approve from the Plan Commission to the Village Board at the August Plan Commission meeting.

V. UNFINISHED BUSINESS

There was none.

VI. NEW BUSINESS

A) Consideration of a Conditional Use Permit for a Remodeling Contractor’s Office and Shops at 7701 North Teutonia Avenue. Requested by Jim Bertram and JM Remodeling.

B) Site Plan Approval for JM Remodeling, proposed for 7701 North Teutonia Avenue. Requested by James B. Meldman.

The two items were taken together.

Several Plan Commissioners commented that the proposed use was a better fit for the site and the neighborhood than previous proposals they had reviewed. Commissioner McGuigan asked if the overhead doors on the proposed garage could be on the east side of the garage rather than on the west side as proposed. He suggested that the proposed garage be built on the west end of the site to accommodate moving the doors to the east façade. The Commissioners agreed with the suggestion in light of the fact that the lot to the west was recently sold and a single family home will be built on it soon.

Commissioners asked the applicant, Mr. Jim Meldman, owner of JM Remodeling and Home Repairs, questions about his operations including the proposed hours of operation, the number and size of trucks, materials, refuse, lighting and noise. The Plan Commission also asked that additional landscaping be added to the west end of the site between the building and the lot line to shield the proposed single family home adjacent to the property from noise and the view of the building.

It was moved by Commissioner McGuigan and seconded by Commissioner Raffensperger to recommend approval of the conditional use and to approve the site plan with the following change: the garage/storage building to be moved to the west end of the site and the overhead doors moved to the east side of the garage/storage building. Discussion continued.

Several Commissioners expressed a concern with the look of the site as it appears from Teutonia Avenue. They wanted to ensure that the site was maintained free of clutter and the landscaping is maintained. Mr. Bertram stated that what appears to be on his property as seen from Teutonia is actually on his neighbor’s property, or he would have cleaned it up long ago.

Commissioners also discussed what they want to see in the presentations made to them as a part of their review of development requests. They directed Mary Kay to make sure that in the future applicants provide the Commission with a complete site plan, colored renderings of building elevations, signage, a landscape plan and a lighting plan in their packets and a presentation of the same at the meeting.

Village President Jaberg suggested as a "friendly amendment" to the motion that the landscaping to the west and north be maintained as a noise and visual buffer. Commissioner McGuigan accepted the amendment, as did Commissioner Raffensperger. The motion, as amended, carried unanimously.

Commissioner Schilz was concerned that the Plan Commission would not have the chance to see the changes they asked for on the site plan. He wanted to make sure that the changes be made immediately and that a presentation of the site plan and the required changes would be made to the Village Board at the Public Hearing. Mary Kay assured Commissioner Schilz that she will review the final submittal and check that all the changes are shown on the site plan.

Mr. Eugene Malloy, 8949 North Silver Brook Lane, asked to be recognized and expressed his thanks to Commissioners. He believed that the dialogue was helpful to his understanding of the issues.

VII. ADJOURNMENT

It was moved by Mr. Raffensperger and seconded by Mr. Krueger to adjourn at 8:55 P.M. The motion carried unanimously.
