May 13, 2002 MEETING MINUTES

The meeting was called to order by Village President Jaberg at 7:30 P.M.
I. ROLL CALL

II. PERSONS DESIRING TO BE HEARD
Helen Witte, representing the Fourth of July Committee. reminded the Plan Commission of the upcoming Fourth of July celebration and distributed raffle tickets for sale and distribution.
III. CONSIDERATION OF MINUTES: April 15, 2002, Regular Meeting
Commissioner Bellehumeur asked that the statement that she desired to serve on another committee be removed from the minutes.
It was moved by Commissioner Raffensperger and seconded by Commissioner Bellehumeur to approve the regular meeting minutes of April 15, 2002, as corrected. The motion carried unanimously.
IV. REPORT OF STAFF/COMMISSION MEMBERS
Mary Kay Buratto reported that she had attended the National Conference of the American Planning Association in Chicago last month. She was able to take advantage of many workshops and seminars related to redevelopment and planning in older suburban areas.
The Village Manager updated Commissioners on the action of the Village Board to approve a phased approach to the relocation of the service drive at Schroeder Drive to prepare for the installation of traffic signals. He explained the three phases to Commissioners. Staff will be working with WisDOT and Ayres Associates, our consulting engineers, to begin the design of the project elements.
V. BUSINESS ITEMS
A. Request for Concept Approval of a Six Unit Condominium Development on 1.14 acres of Land at 8633 North 43rd Street in the Original Village
Mary Kay introduced the proposal and explained that the Village Code requires that all residential dwellings other than single family detached, are classified as "apartment buildings" and must have a minimum of 80% brick or stone on the building. By ordinance, only the Building Board can make exceptions to this requirement. The applicant is proposing a vinyl sided building. Mr. Gavic, the builder, stated that the requirement for that amount of brick would make this project cost prohibitive. He is planning two single family detached and two ranch-style duplex buildings on the property. Plan Commissioners discussed the materials on the existing residences and other buildings in the original Village and concluded that a natural wood siding would be more appropriate than masonry. Mr. Gavic agreed, at the request of the Plan Commission, to use cedar siding on the condominiums.
Members of the Commission reviewed the width of the private drive along with the location and the number of visitor parking spaces. They concluded that the proposed 15 foot wide driveway was sufficient, because it will function more like a shared driveway than a private road. Commissioners asked the developer to increase the length of the individual driveways for units 2,3,4 and 5 to accommodate the parking of two cars. Mr. Van Gompel reminded Commissioners that this development will be an excellent buffer between the more commercial north half of the original Village and the residences to the south.
Village President Jaberg suggested that the developer consider a landscape plan that will deter geese from using the site. Commissioner McGuigan expressed a concern that the location of the pond at the lowest point on the property might cause the basements of the residences to flood in a storm. Mary Kay assured Commissioner McGuigan that the location of the pond would not cause the basements to flood.
Mary Kay suggested that the applicant approach the Building Board with elevations, colored rendering and a sample of the materials for the siding and roof for concept approval before beginning the platting process. She will confer with Bob Premo, staff liaison to the Building Board, and then convey the necessary information to the applicant.
It was moved by Trustee Schilz and seconded by Commissioner Raffensperger to grant concept approval to the condominium use but with natural cedar siding, to recommend to the Building Board to waive the requirement for any brick or stone on the building, and to replace the incorrect address with the correct tax key number. The motion carried unanimously.
B. Request for a Recommendation for a Conditional Use Permit for a Child Day Care Facility and a Training Program for Entry-Level Child Care at 4811 West Bradley Road. Requested by Jerome Gottfried, property owner, for Ms. Carmen Ray
Commissioners reviewed a proposed child care training center and daycare facility for the strip mall located between 4747 and 4815 West Bradley Road, in approximately 2,000 square feet of the building identified as 4811 West Bradley Road. Carmen Ray, a Brown Deer resident with over 20 years of child care experience, would manage the operations of both facilities. The proposed uses will also be licensed through the State of Wisconsin. Ms. Ray is a state approved administrator and program director for day care facilities and child care training. She told Commissioners that the license goes with the premises, and that the State will require that she obtain a license for this facility. The Village will require documentation of her license or certification with the State as a condition of the use. Mr. Tajnai, another Brown Deer resident, will partner with Ms. Ray on this business venture. He will own the business and hire Ms. Ray to run it. They will lease the space from building owner, Jerome Gottlieb.
Commissioners had many questions relating to the utilization of the indoor space. Ms. Ray was asked if there would be an outdoor play area. She is considering using a grassy area next to the beauty salon, but will only have play equipment that can be brought out during playtime and brought in again afterward. The State requires a certain type of equipment in outdoor play areas. As with the recent review of Hospitality Child Care at the Commerce Center, the Commissioners wanted to see an interior floor plan. The interior floor plan shall indicate the areas for the different age groups, where food will be prepared and served, a separate sink for hand washing, a water fountain, the area that will be used for training. An exterior site plan shall indicate an outdoor play area and the type of equipment that will be brought out for play.
Commission members also requested that Ms. Ray provide a site plan of the shopping center indicating the parking lot showing the location of the bus route and bus drop-off site as well as a location for the drop-off and pick-up of children. The drop off areas need to be properly marked. Commissioner Bellehumeur expressed a concern about traffic in the parking lot and asked if Ms. Ray could begin with one use and transition to the other over time. Commissioners want Ms. Ray to present a detailed operations plan for their review. Trustee Schilz questioned if 60 children would be too many for the space. Ms. Ray stated that her license would be for 40 children in the 2,000 square feet of space. Her market extends beyond Brown Deer.
Plan Commission members, by consensus, held the request over until the applicant could come before the Commission in the future with the following submittal: 1) a signed agreement for the lease of 2,000 square feet of space, 2) a signed agreement between Ms. Ray and Mr. Tajnai memorializing their business relationship, 3) a detailed site plan, 4) a detailed floor plan, and 5) a detailed operation plan for both the day care (limited to 40 children per state regulations) and the training facility.
