NOVEMBER 6, 2000 MEETING MINUTES

HELD AT THE BROWN DEER VILLAGE HALL

4800 WEST GREEN BROOK DRIVE

The meeting was called to order by President Wolfgram at 7:30 P.M.

I. Roll Call

Present: Village President Wolfgram, Trustees: Krueger, Kundinger (8:50), Moranski, Nealy, Schilz, Schneider

Excused: None.

Also Present: Russell Van Gompel, Village Manager; Todd Schmidt, Assistant Village Manager; William Dineen, Village Attorney; Marty Glodoski, Water Utility Superintendent; Steven Rinzel, Chief of Police; John Graeber, Captain of Police; Charles Wenten, Captain of Police

II. Persons Desiring to be Heard

Gary Hanson (5731 West Glenbrook Road) commended Larry Neitzel, Operations Superintendent, for being helpful in addressing citizen concerns regarding the culverts. Mr. Hanson presented various concerns regarding the ditches, including safety and maintenance concerns. He presented possible solutions, including concrete inverts, rock fill, ground cover, and culverts running the length of the ditches.

John Gibbs (8542 North 63rd Street) appeared regarding the disciplinary hearing involving Officer Shea. He said that the hearing shows how the Police Department operates, and encouraged the Village Board members and residents to attend the hearings.

Kurt Gross (5331 West Glenbrook Road), Charles Muth (5698 West Silverleaf Lane), Liesel Muth (5698 West Silverleaf Lane), Richard Kruse (5695 West Silverleaf Lane), Susan Kruse (5695 West Silverleaf Lane), Edna Steitz (5326 West Silverleaf Lane), Harriet Weiss (5253 W. Silverleaf Lane), John Biro (5672 West Glenbrook Road) and Amy Biro (5672 West Glenbrook Road) appeared to express concerns regarding the ditches in their neighborhood. Issues such as poor quality driveway pavement, ditch depth, and the safety of small children were presented.

Mr. Van Gompel noted that top soil and seeding would occur in Spring of 2001. He noted that the Finance and Public Works Committee would be presented with the concerns and options as noted by the residents in the area. Trustee Schneider discussed the tasks and consideration that will be undertaken by the Finance and Public Works Committee.

A recommendation was made by a member of the audience to place reflectors on the edge of the road pavement.

III. Consideration of Minutes: October 16, 2000 - Regular Meeting

October 30, 2000 - Special Meeting

It was moved by Trustee Moranski and seconded by Trustee Nealy to approve the October 16, 2000 regular meeting minutes. The motion carried unanimously.

It was moved by Trustee Schneider and seconded by Trustee Moranski to approve the October 30, 2000 special meeting minutes. The motion carried unanimously.

V. New Business

A) Acceptance of Watermain Dedication and Easement Agreement for Brown Deer Senior Housing

Mr. Van Gompel reviewed the requested action of the Village Board.

It was moved by Trustee Nealy and seconded by Trustee Moranski to adopt Resolution No. 00, "In the Matter of Approving a Watermain Easement Agreement With Brown Deer Senior Housing, L.L.C. at Algonquin Manor Senior Apartments, 5005 West Bradley Road, Brown Deer, Wisconsin". The motion carried unanimously.

B) Resolution No. 00-, "In the Matter of Furnishing Water to Eric Hill, 4448 W. County Line Road, Mequon"

Mr. Van Gompel reviewed the requested action and Mr. Glodoski discussed the charges and regular rates that will be assumed by the property owner. Trustee Krueger asked how the charge is determined. Mr. Glodoski noted that Don Esche, accountant for the Utility, calculates the charges.

It was moved by Trustee Schneider and seconded by Trustee Moranski to adopt Resolution No. 00-, "In the Matter of Furnishing Water to Eric Hill, 4448 W. County Line Road, Mequon". The motion carried unanimously.

C) First Amendment to Declaration of Conditions, Covenants and Restrictions of Brown Deer Estates Subdivision

Mr. Van Gompel reviewed the requested action of the Village Board. He discussed the relation of this property to the Donges Woods Subdivision. He noted that the amendment has been reviewed and recommended by Attorney Dineen.

It was moved by Trustee Nealy and seconded by Trustee Schneider to approve "The First Amendment to Declaration of Conditions, Covenants and Restrictions" relating to Brown Deer Estates Subdivision. The motion carried unanimously.

VI. Departmental Report - Police Department

Chief Steven Rinzel presented the Brown Deer Police Departmental report. He discussed the Citizens Academy, structure of the department, and development of personnel. Captain Wenten discussed the Support Services division, detailing the dispatch, crossing guards, crime prevention, Citizens Academy, and computer support programs. He presented a summary of police response activities since January, 2000, to demonstrate the capabilities of the computer aided dispatch system. Captain Graeber discussed the Operations division, detailing the departmental personnel and staffing, mentoring and training programs.

VII. Administrative Report

Mr. Van Gompel reported that a Budget Workshop is scheduled for this Thursday, and preparations are in place for the election tomorrow. He expressed thanks to the Village staff for dealing with the work load. He noted that a citizen encountered problems in Village Hall with regards to proper documentation for registering to vote. The customer became upset, however the situation was dealt with fairly. A column appeared in the Sunday Journal/Sentinel regarding the incident. He noted that the review of candidates continues for a Community Development Director.

 

 

VIII. Recess into Closed Session pursuant to ' 19.85(1)(g) Wisconsin Statutes for the following reasons:

g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to be become involved.

It was moved by Trustee Schneider and seconded by Trustee Moranski to recess into closed session pursuant to ' 19.85(1)(g) Wisconsin Statutes for the reasons stated in the agenda at 8:55 P.M. The motion carried unanimously.

IX. Reconvene into Open Session for possible action on Closed Session deliberations

It was moved by Trustee Schneider and seconded by Trustee Krueger to reconvene into open session for possible action on closed session deliberations at 11:59 P.M. The motion carried unanimously.

It was moved by Trustee Schneider and seconded by Trustee Moranski to schedule a public hearing for a Conditional Use Permit request by Brisben Companies on November 27, 2000, at 7:00 P.M. The motion carried unanimously.

X. Adjournment

It was moved by Trustee Nealy and seconded by Trustee Schilz to adjourn at 12:01 A.M. The motion carried unanimously.
