MARCH 5, 2001 MEETING MINUTES
HELD AT THE BROWN DEER VILLAGE HALL
4800 WEST GREEN BROOK DRIVE
The meeting was called to order by President Wolfgram at 7:30 P.M.
I. Roll Call
Present: Village President Wolfgram, Trustees: Krueger, Moranski, Nealy, Schneider
Excused: Trustee Kundinger, Trustee Schilz
Also Present: Russell Van Gompel, Village Manager; William Dineen, Village Attorney; Kathy Kasza, Treasurer/Comptroller
II. Persons Desiring to be Heard
Robert Guilbert, 8041 North Cedarburg Road, appeared and expressed his concerns with noise and exterior lighting from Hansen Storage and Beloit Beverage buildings. He also accused the Village of cutting trees and shrubs between his property and the above noted businesses. He further requested that the Village plant trees along the WEPCO right-of-way to shield his property. The Village Manager will review the situation and report back to the Board and Mr. Guilbert.
Tom De Bauche, Green Bay Pipe & TV Contractors, LLC, appeared and expressed his concerns with the bidding procedures used for MMSD I/I Contract. He felt that the Village should not award a contract to the low bidder, since the bid was not received by the deadline.
III. Consideration of Minutes: February 19, 2001 - Regular Meeting
It was moved by Trustee Moranski and seconded by Trustee Schneider to approve the February 19, 2001 regular meeting minutes. The motion carried unanimously.
IV. Unfinished Business
A) Award Contract for MMSD I/I Project
Jim Buske, Engineering Technician, explained the procedures followed when accepting bids for the project. He noted that the bid from IHC was delivered by Federal Express between 4:00 and 5:00 p.m. at which time he was not in the office. The following morning, he called Village Attorney Dineen for advice and followed the recommended action of the Village Attorney. Attorney Dineen commented on a case, Power Systems v. Bloomer, in which a late bid can be accepted under certain circumstances, namely that the bid was sealed and was presented to a carrier prior to the bid deadline. The circumstances surrounding the IHC bid closely match those from the Bloomer case.
It was moved by Trustee Schneider and seconded by Trustee Moranski to award Contract No. C063DE001 to IHC Rehabilitation Products for the lining of sanitary sewer laterals in the amount of $132,750.00 for the Infiltration and Inflow Reduction Demonstration Project contingent upon approval by the MMSD Board of Commissioners.
Trustee Krueger stated that he could not support the acceptance of a late bid under any circumstances and he believed that is was immoral and unethical to do so. He further stated that in his business, steps were taken to ensure that bids were received by the deadline. Trustee Schneider suggested that the awarding of the contract be forwarded back to the Finance and Public Works Committee, since the committee was unaware of the late bid.
It was moved by Trustee Schneider and seconded by Trustee Nealy to refer the item back to the Finance and Public Works Committee for further consideration. Attorney Dineen reminded the Board that bids normally are valid for a certain time period and that the bids might expire before the next Village Board meeting. Jim Buske reported that the bids are valid for 30 days. Staff will contact the bidders for an extension of the time period, and schedule a special meeting if necessary. The motion carried unanimously.

VI. Departmental Report - Administrative Services
Kathy Kasza reported on recent staff changes and suggested that a more detailed report be provided when the 2000 Comprehensive Annual Financial Report is completed.
VII. Administrative Report
Mr. Van Gompel read a Thank You Card received from the Earl McGovern family. He reported that the Planning Commission and public hearing scheduled for March 12, 2001 will be cancelled

It was moved by Trustee Schneider and seconded by Trustee Moranski to adjourn at 8:35 P.M. The motion carried unanimously.
