WISCONSIN'S NEW TEXTING WHILE DRIVING LAW
|
Wisconsin now has a new texting while driving law that took effect on December 1st, 2010. The new law permits drivers to talk on their cell phones; however, they cannot send e-mails or text messages.
In a recent report by the Advocates for Highway and Auto Safety they state that while behind the wheel, those who use phones and electronic devices on the road drive much like motorists impaired by alcohol. The group said 5,870 people were killed and 515,000 injured in the United States in 2008 alone as a result of drivers that were distracted while operating a motor vehicle. In Wisconsin, the new texting while driving law, Wisconsin State Statute 346.89(3)(a), reads; "No person may drive any motor vehicle while composing or sending an electronic message or an electronic mail message." This violation is also a primary enforcement action; meaning law enforcement officers can stop operators while driving solely for observing this violation and can issue a citation to the driver for texting while driving. In the Village of Brown Deer composing or sending an electronic text or mail message while driving carries a $101.40 fine and 4 demerit points.
